But there’s a catch: Many Georgia policies limit how long you have to sue—sometimes just one or two years from the date of loss, even though the general contract limit is six. Wait too long and the insurer can use its own fine print to shut the courthouse door. As a result, it can be important to file a proof of loss as soon as you can do so accurately and thoroughly.
In addition, before suing for bad faith, you must send a written demand and give the insurer 60 days to make it right. Miss that step, and you lose the bad-faith remedy.
