Can I sue my insurance company if they underpaid my claim?

Potentially, yes. If your insurer failed to pay the full value of a covered loss, improperly denied part of the claim, or relied on an inaccurate damage estimate, you may have legal options. An attorney can review your policy, the insurer’s valuation, and the evidence supporting your loss to determine whether litigation or another dispute process is appropriate.

Do I need a lawyer if the insurance company already sent an adjuster?

An insurance adjuster works for the insurance company or is hired to evaluate the claim on its behalf. Their involvement does not necessarily mean your interests are fully protected. An attorney can independently review coverage, challenge disputed findings, work with outside experts when needed, and pursue legal action if negotiations fail.

How long does the insurance dispute process typically take?

There is no single timeline. Some disputes can be resolved through negotiation or pre-lawsuit intervention, while others may require appraisal, expert investigation, litigation, or trial. The complexity of the damage, the insurer’s position, the amount in dispute, and the legal process all affect how long a case may take.

What is “Bad Faith,” and how do I know if my insurer is doing it?

Bad faith generally refers to improper insurer conduct that goes beyond an ordinary disagreement about the value or coverage of a claim. Examples may include unreasonable delays, inadequate investigations, ignoring important evidence, or denying a claim without a legitimate basis. Whether conduct legally qualifies as bad faith depends on the law of the state and the specific facts of the claim.

I already have an “Independent Adjuster”—why do I need an attorney?

Despite the name, an independent adjuster is often hired by an insurance company to investigate and evaluate claims. An attorney serves a different role: protecting your legal interests, interpreting policy and coverage issues, challenging improper claim decisions, and filing a lawsuit when necessary. When a dispute moves beyond estimating damage and becomes a legal conflict, an attorney can take steps an adjuster cannot.
